ProfitKORE Solutions LLC Terms and Conditions

Client Services Agreement & Terms of Service. By checking the box and submitting payment or onboarding information, you acknowledge that you have read, understood, and agree to the following terms with ProfitKORE Solutions, LLC

1. Term Your service agreement begins on the date of acceptance and continues for an initial term of twelve (12) months. After the initial term, the agreement will automatically renew for successive twelve (12) month terms unless written notice of cancellation is provided at least thirty (30) days prior to the end of the current term. At the Company’s sole discretion, a month-to-month option may be offered after the initial term upon written request.

2. Services Provided. ProfitKORE Solutions provides access to its AI-powered business automation platform, which may include:

  • AI Voice Receptionist

  • Website chat (text and/or voice)

  • Appointment scheduling and calendar integration

  • Workflow automations

  • Funnel and/or website setup, if included in your package

  • CRM system configuration and backend support

Included services will depend on the package selected.

3. Implementation & Onboarding. Client understands that onboarding and implementation require significant time, labor, and resources. Implementation may include:

  • System configuration and setup

  • AI voice scripting and customization

  • Workflow and automation buildout

  • Calendar integration and booking logic

  • Testing and deployment

Typical implementation time is approximately 2–4 weeks, depending on responsiveness and project complexity. Client agrees to:

  • Provide accurate and timely business information

  • Supply required access to systems such as calendar, domain, phone, and other necessary tools

  • Respond promptly to onboarding requests

Delays caused by the Client may extend implementation timelines.

4. Fees & Billing. Setup fees and monthly subscription fees will be disclosed at the time of purchase or package selection. By accepting these terms, Client agrees to the applicable one-time setup fee and recurring monthly subscription fee associated with the selected package

5. Payment Terms. Payments are billed automatically using the approved payment method on file.

  • Monthly fees are billed in advance

  • The first month may be prorated when applicable

  • Failure to pay may result in suspension or termination of services.

6. Refund Policy & Financial Protections

Setup Fees. Setup fees are non-refundable once implementation has begun due to allocated labor, resources, and third-party costs.

Monthly Fees. Monthly subscription fees are non-refundable once billed, except in rare and documented cases of service failure as determined by the Company.

Good Faith Resolution. In the event of a service concern, ProfitKORE Solutions agrees to:

  • Investigate the issue promptly

  • Work in good faith to address the concern

  • Provide reasonable remediation efforts where appropriate

Refunds, credits, or adjustments are not guaranteed and are issued solely at the Company’s discretion.

Chargebacks. Client agrees not to initiate a chargeback without first giving the Company a reasonable opportunity to investigate and attempt to resolve the issue.

7. Service Level Expectations. ProfitKORE Solutions aims for 99% platform uptime, excluding:

  • Scheduled maintenance

  • Third-party outages, including carriers and integrations

  • Force majeure or events outside the Company’s contro

Issue response targets are generally:

  • Critical issues: 4–24 hours

  • Standard issues: 24–48 hours

The Company will make commercially reasonable efforts to resolve issues as quickly as possible. Client understands that:

  • AI systems are not guaranteed to perform without interruption or error

  • Occasional missed calls, delays, or inaccuracies may occur

  • Third-party systems such as phone carriers, internet providers, and integrations may affect performance

These limitations do not constitute grounds for cancellation or refund.

8. Performance Disclaimer. ProfitKORE Solutions does not guarantee:

  • Specific revenue results

  • Lead conversion rates

  • Increased call volume

  • Increased bookings

Results depend on many external factors, including business operations, staffing, offer quality, and market conditions.

9. Client Conduct. Client agrees to:

  • Use the system lawfully and ethically

  • Not abuse, misuse, reverse engineer, or interfere with the platform

  • Maintain professional communication with the Company

10. Termination. Client may not terminate the agreement during the initial term without written consent from the Company.

The Company reserves the right to suspend or terminate services in the event of non-payment or material violation of these terms.
